Before you start

Every app asks you to agree to something, and most of those documents are written so that nobody reads them. This one is meant to be read.

It is short, it is in ordinary words, and where we ask something of you we explain why. If any part of it seems unreasonable, please tell us. The email address is at the bottom.

The whole thing, in eight lines

Everything below explains those eight in more detail.


Who can play

You need to be 13 or over. Some countries set a higher age for agreeing to something like this without a parent. If yours does, that age applies to you.

You will need a Discord account for anything that lasts: your profile, your stats, your gang, and the cosmetics you have earned. You can play as a guest without one.

Discord accounts less than 7 days old cannot be linked. This is not about you personally. When somebody is banned, the usual next step is to create a fresh Discord account and come back, and while a new account costs nothing, a ban means very little. Requiring a week of account age makes that harder. You can play as a guest in the meantime.

One person, one account

Please do not share your account, sell it, or buy one.

Please also do not run several accounts at once to gain an advantage. In practice that means three things:

We care about this more than almost anything else, because this game is judged by the people in the room. If four of the seven players are the same person, the scores stop meaning anything, and everybody else in that room spent twenty minutes making something for nothing.

When we look into it, we check whether accounts are connecting from the same address or the same browser. The privacy page explains exactly what that involves.

How to behave

The following are not allowed anywhere in the game, including lobby chat, gang chat, your display name, your bio, track titles and voice:

If somebody does one of these to you, please use the report button. A person reads every report. If somebody reports you, that is not a punishment in itself. It means a person is going to look at it.

Your music stays yours

Uploading a track here does not make it ours. You can still sell it, release it, or license it anywhere you like, exactly as though you had never used this game. Nothing you give us is exclusive, and nothing here signs any of your rights away.

What you give us permission to do is only what the game visibly does:

That is the full extent of it. We do not sell your music, we do not license it to anyone, and it does not appear anywhere outside the game.

The file the room plays is deleted as soon as the lobby closes, and while it exists it sits at a randomly generated address that cannot be guessed. We are conscious that this is often unreleased music, and it is not left on a public link.

When you upload, you are telling us that it is yours to upload: that you made it, or that you have the rights to it, and that there is nothing uncleared in it. We take your word for this, because there is no practical way to check where every sound in a file came from. If it turns out not to be true, the responsibility is yours rather than ours, and we will take the file down.

If you drop a sample into a round, the room is going to build on it during that round. That is what those modes are for, and you are agreeing to it when you add the file. You are not signing away your rights by doing so. If somebody wants to release what they made using your sample, they need to ask you. The section below explains the same rule from the other side.

Donating a beat or a sample to the library is a separate and wider agreement, and you are shown its own terms at the time. Please do not treat this section as covering it. In short: other players build on it and keep what they make, you are credited each time, and you can withdraw it whenever you want, although tracks already made with it stay up.

We do not train AI on your music

Never. Not now, and not later.

We do not use anything you upload to train AI models. Not our own models, and not anyone else's. We do not sell it, license it, or pass it to any company that would use it for that purpose, and we never will.

This is not a position we intend to review. It is not a current policy that a future version of this agreement might quietly reverse. It is a permanent commitment, and it covers everything you put into the game: tracks, beats and samples alike.

If you ever see anything suggesting otherwise, we have broken our word to you, and you are entitled to say so publicly.

Your music is here so that people can listen to it and score it. That is the whole of its job.

Using other people's beats and samples

The beats and samples in the game are there for you to make something with. You can rap over them, flip them, and keep the track you make. That is what those modes are for.

Inside a round you are fine. Everybody who put audio into the game knew that was what it was for.

Releasing it afterwards is your responsibility

Please read this part carefully, because it is the one that can cause you a problem later.

Playing something in a round is not the same as clearing it for release. If you want to put a track you made here on Spotify, on YouTube, on a mixtape, or anywhere else outside this game, getting permission for the sample underneath it is your responsibility. It is not ours.

There are two situations, and the second is the one people misjudge:

We do not check, and we cannot vouch for anyone

We take people at their word about what they upload. When somebody adds audio, they tell us it is theirs and that there is nothing uncleared in it. We have no way to verify that, and we do not attempt to, because nobody can listen to every upload and know where every sound originated.

So, to be direct about it:

None of this prevents you from playing. It concerns what happens after the round ends.

Other points

Please do not take the library itself. That includes extracting the files, sharing them, and re-uploading them elsewhere.

The music that plays in the menus belongs to the artists credited on it.

Creds are points, not money

Creds exist only inside SONG WARS and have no value outside it. You cannot cash them out, transfer them to another player, or sell them. They are a score, in the way that coins in any other game are a score.

Wagering creds is not gambling, because what you are risking is not money. No real money goes in and none can come out. We only open wagers in matches that the matchmaker arranged. If a room looks arranged by the players in it, we will not put creds on the table, because that is how people get taken advantage of.

Cosmetics are a licence to use an item in the game rather than something you own outright, whether you earned it with creds or bought it with money. If your account ends, access to the items ends with it.

We will adjust the numbers from time to time. Prices, payouts and balances get tuned, because this is a game economy rather than a bank account. If we find that creds were earned by cheating, we will remove them.

While the game is in beta, an economy can be reset. We will not do that casually, and we will tell you if we do it.

Buying things

Nothing in SONG WARS costs real money today, and we intend to change that: there will be a shop, selling cosmetic items. When it opens, the following applies to it.

Sales are final and we do not offer refunds. Anything you buy is delivered to your account immediately and cannot be returned, which is the reason. Please buy something because you want it, rather than because you expect to be able to change your mind afterwards.

What you are buying is a licence to use an item in the game, not ownership of it, and not anything that can be resold or cashed out. If your account ends, access to the items ends with it.

We will never see your card details. Payments will be handled by a payment company, and your card number goes to them rather than to us.

Two exceptions, which we would rather state than leave you to discover:

None of this applies to creds. Creds are earned by playing, are not sold, and have never been money.

Voice chat

Voice is live and is never recorded. No recording exists anywhere, including on our side.

Voice is also routed through a relay rather than connecting you directly to the other players. A direct connection would show everybody in the room your IP address, and in a game where players have creds at stake that is not something we are willing to expose.

Voice is switched off during production phases in ordinary rooms.

The behaviour rules apply to voice as they do everywhere else. Please be aware that because nothing is recorded, a report about voice rests on what other people in the room say.

When something goes wrong

We can suspend or permanently lock an account for breaking this agreement. A lock does not delete you. Your profile and settings continue to work, but you cannot enter a lobby or use gang chat. You are always told the reason.

We can also block an address. This is a blunt measure and we know it, because shared connections mean it can affect somebody who did nothing wrong. We only use it when locking the account is not working.

Hosts can remove people from their own lobby. That is not a ban and does not involve us.

If you believe a decision was wrong, please tell us. We would much rather hear from you than have you leave.

The game is new, and that has consequences

SONG WARS is in beta. In practical terms:

The service is provided as it currently is. We cannot guarantee that it will be available, that files will survive, or that it will suit any particular purpose.

To the extent that the law where you live allows it, we are not liable for lost work, lost creds, lost progress, or anything that follows from them. Where the law does not allow that, our liability is limited to the smallest amount the law permits. Nothing here removes a right you have that cannot be removed.

That paragraph is written for lawyers rather than for you, and we would rather point it out than bury it.

Leaving

You can stop whenever you like. Closing the tab is enough.

If you would like your account and data deleted, please ask at the email address below and we will do it. There are two things we cannot delete, and both have a reason:

When this changes

This agreement will change, because the game is still being built. When something meaningful changes, we will ask you to read it again before your next match, and we record which version you agreed to. Correcting a typo will not interrupt you.

Legal details

If any part of this agreement turns out not to be enforceable, the rest of it still applies.

If we disagree about something here and cannot resolve it between us, the law of the Commonwealth of Massachusetts, United States applies, that being where the person running SONG WARS lives.

Wherever you are playing from, this does not remove rights your own country gives you that cannot be signed away. If you are in the UK or EU, you keep your consumer and data protection rights whatever this page says.

Contact

SONG WARS is made and run by one person in Massachusetts, in the United States, rather than by a company. When you write in, you are emailing the person who built it rather than a support desk.

That person does not publish their legal name, which is a safety decision rather than an attempt to be difficult to reach. If you need it for a genuine legal reason, such as a formal complaint or a rights claim about a track, please email and ask, and you will be told.

For anything concerning another player's behaviour, please use the report button in the game rather than email. It attaches the match, which an email cannot.
